Terms of Service

These Terms of Service (“Terms”) govern your access to and use of DigestCast (the “Service”), available at digestcast.com and app.digestcast.com. The Service is operated by Individual Entrepreneur KIRILL GOLODNOV, Identification Number 300455745 (“we”, “us”, “our”).

By creating an account, accessing, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. The Service

DigestCast helps you generate personalized digests based on sources you choose (for example RSS links, websites, channels, or other URLs) and instructions you provide (for example a prompt).

The Service may use third-party AI models and infrastructure to produce summaries and other outputs.The Service is provided on a free plan with usage limits and on paid subscription plans. We may change plans, pricing, and usage limits as described in Section 9.

2. Eligibility

The Service is not intended for children under 13 (or the minimum age required to consent to the processing of personal data in your country, if higher).

By using the Service, you represent that you meet this minimum age. If you are under the age of majority where you live, you represent that you have your parent’s or legal guardian’s permission to use the Service. We do not knowingly collect personal data from children under the applicable minimum age.

If we learn that a user is under the applicable minimum age, we may suspend or terminate the account and delete associated data.

3. Accounts and Security

You can create an account using an email and password or via Google sign-in. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.

You agree to provide accurate information and to keep it up to date. We may suspend or terminate accounts that appear to be used fraudulently or abusively.

4. Your Inputs and Sources

“Inputs” include the prompts, instructions, links, sources you select, and any other content you submit to the Service. You remain responsible for your Inputs and for the sources you choose to use with the Service.

We do not claim ownership of your Inputs. We also do not own, control, or claim any rights to content from third-party or public sources (such as websites, RSS feeds, publications, or platforms). Third-party content remains the property of its respective owners.

You represent that your use of the Service, your Inputs, and your selection and use of sources comply with applicable law and do not infringe or misappropriate third-party rights. You are also responsible for complying with any terms, access rules, or restrictions imposed by the third-party sources you choose to use.

If you provide a link to third-party content, you acknowledge that we may access that content as necessary to provide the Service. We are not responsible for third-party sources, their content, availability, or terms.

5. Acceptable Use

You agree not to:
– Use the Service for unlawful, harmful, or abusive purposes;
– Attempt to probe, scan, or test the vulnerability of the Service, or bypass security or rate limits;
– Reverse engineer, copy, or resell the Service (except as permitted by law);
– Use automated means to access the Service in a way that materially exceeds normal human usage, unless we have given you written permission;
– Upload or link to content that infringes intellectual property rights or violates privacy or confidentiality obligations;
– Use the Service to generate or distribute malware, phishing content, or spam.

We may suspend or terminate access if we reasonably believe you have violated this section.

6. AI Outputs and Disclaimer

The Service generates outputs using automated systems. Outputs may be inaccurate, incomplete, out of date, or misleading. You are responsible for verifying outputs before relying on them.

The Service does not provide professional advice (legal, medical, financial, or otherwise). Any output is for informational purposes only.

7. Intellectual Property

We and our licensors own all rights in the Service, including software, designs, logos, and content we provide (excluding your inputs). You receive a limited, non-exclusive, non-transferable right to use the Service while your account is active and you comply with these Terms.

As between you and us, you retain your rights in your inputs. You grant us a worldwide, non-exclusive license to host, process, and use your inputs only to provide, maintain, and improve the Service, and to enforce these Terms.

8. Third-Party Services and Content

The Service may integrate with or rely on third-party services (for example Google sign-in, AI providers, hosting, analytics, and payment processors). Your use of third-party services is governed by their terms and privacy policies.

When you provide links to third-party sources, the underlying content remains the property of its owners. We do not endorse third-party content and are not responsible for it.

9. Plans, Usage Limits, and Payments

Free plans may include a limited amount of usage (for example, a monthly number of AI tasks/tokens). Paid plans are billed in advance on a recurring basis (monthly or yearly) unless stated otherwise.

Payments are processed by third-party payment processor(s). We do not store full payment card details on our servers. You authorize us and our payment processor(s) to charge your payment method for recurring subscription fees, applicable taxes, and any add-ons you purchase. The applicable processor may change from time to time and will be disclosed at checkout.

We may change our prices and plans from time to time. If a price change affects your current subscription, we will provide reasonable notice, and the change will apply at the next renewal unless required otherwise by law.

Auto-renewal. Unless you cancel before the end of your current billing period, your subscription will automatically renew and we (and/or our payment processor) will charge your payment method at the then-current rate, plus any applicable taxes.

Cancellation timing. To avoid being charged for the next billing period, you must cancel at least 24 hours before your renewal date and time. Cancellations made within 24 hours of renewal take effect for the following billing period, and the subscription may renew once.

Taxes. Prices may exclude taxes (such as VAT, GST, or sales tax) unless stated otherwise. You are responsible for all applicable taxes, and we may collect taxes where required.

Failed payments. If a payment is declined or cannot be processed, we (and/or our payment processor) may retry the charge, and we may suspend or limit your access to paid features until payment is received.

We may enforce usage limits and may throttle, restrict, or suspend usage if you exceed them.

10. Cancellation, Renewals, and Refunds

You can cancel your subscription at any time in your account settings. Unless required by law, cancellations take effect at the end of the current billing period. You will retain access until the end of that period.

Except where required by law, subscription fees are non-refundable and we do not provide prorated refunds for partial billing periods.

Chargebacks and payment disputes. If you initiate a chargeback or payment dispute, we may suspend or terminate your access and account, and we may refuse future purchases from you.

11. Termination

You may stop using the Service at any time. We may suspend or terminate your access immediately if we believe you breached these Terms, used the Service unlawfully, or posed a security risk.

Upon termination, your right to use the Service ends. Sections that by their nature should survive will survive (including intellectual property, disclaimers, limitation of liability, and governing law).

12. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE". TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, error-free, or that outputs will be accurate.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE AMOUNT YOU PAID TO US FOR THE SERVICE IN THE 30 DAYS BEFORE THE EVENT GIVING RISE TO THE CLAIM. IF YOU PAID NOTHING, OUR TOTALLIABILITY IS USD 0.

NOTHING IN THESE TERMS EXCLUDES OR LIMITS LIABILITY THAT CANNOT BE EXCLUDED OR LIMITED UNDER APPLICABLE LAW.

14. Indemnity

You agree to indemnify and hold us harmless from claims arising out of your inputs, your use of the Service, or your violation of these Terms or applicable law.

15. Governing Law and Disputes

These Terms are governed by the laws of Georgia, without regard to its conflict-of-law rules. Any dispute arising out of or relating to these Terms will be resolved exclusively in the competent courts of Tbilisi, Georgia, unless applicable law provides otherwise.

16. Changes to These Terms

We may update these Terms from time to time. If changes are material, we will provide reasonable notice (for example by email or in-app notice). Continued use after the effective date means you accept the updated Terms.
